“We”, “us” and “our” mean the relevant company providing the repair or sale. “You” means the customer.
2. Contact and acceptance
You can contact us at info@esky.repair or through the contact options on our website. By approving a repair, paying a deposit, placing an order or purchasing goods, you agree to the version of these terms made available to you at that time.
3. Assessments, estimates and repairs
Our repair services cover the device types listed on our website, including selected models of GHD straighteners. Please provide the model and fault details so we can confirm whether we can accept the repair.
Initial repair estimates and assessments of non-repairable devices are normally free. A written estimate is a separate chargeable service; we will tell you the charge before preparing it.
An estimate is based on the information and inspection available at the time. If we discover additional faults or costs, we will seek approval before carrying out materially different work. We will provide repair services with reasonable care and skill.
We may decline work that is unsafe, unlawful, beyond our capability or where suitable parts are unavailable. Estimated completion dates are not guaranteed where delays arise from parts availability, further faults or circumstances outside our reasonable control.
4. Deposits and payment
We may request a deposit where parts must be ordered or a repair is unusually costly. We will confirm the amount and purpose before payment. If you cancel, we may retain only reasonable costs already incurred, including non-returnable special-order parts where this was made clear in advance.
Payment is due when agreed or, otherwise, when the repaired device is collected or goods are purchased. We accept cash, Revolut, Monzo, BACS and PayPal. A payment is complete only when cleared funds are received.
5. Cancelling a repair
For a repair arranged in person at our workshop, you may cancel before work begins, but you must pay reasonable costs already incurred, including approved parts. Once work has begun, you must also pay for work properly completed up to cancellation.
Where a consumer arranges a repair entirely online or by phone, a legal 14-day cancellation period will normally apply. If you ask us to start within that period, you expressly request early performance and may have to pay a proportionate amount for work and parts supplied before cancellation. If the service is fully completed during the period following your express request and acknowledgement, the cancellation right may end.
6. Customer-supplied parts
We may accept customer-supplied parts at our discretion. Our repair warranty covers our workmanship but not the quality, compatibility, performance or lifespan of a part you supplied. We are not responsible for an inherent defect in such a part. Additional diagnosis, removal or repeat labour caused by a defective or incompatible customer-supplied part may be chargeable where agreed with you.
7. Device data and access
You should back up your device and remove sensitive information before providing it to us wherever reasonably possible. You should tell us about security features that could prevent agreed work. Repair procedures can involve a risk of data loss, particularly where a device is already damaged.
We do not guarantee that data can be preserved and are not responsible for pre-existing loss or corruption, or loss that could not reasonably have been avoided. Nothing in these terms excludes responsibility for loss caused by our failure to use reasonable care and skill or any liability that cannot legally be excluded. We will access device content only where reasonably necessary for the agreed diagnosis, repair or testing.
8. Collection, postage and uncollected devices
Repaired devices and purchased items may be collected in person. When we notify you that an item is ready, we will also confirm the collection hours available for that week.
For repaired items and purchased products, we offer return postage through Royal Mail at £6 for Tracked delivery or £10 for Special Delivery. Larger items may cost more to send; where a different price applies, we will advise you before the final invoice is issued. Risk passes in accordance with applicable consumer law; please inspect delivered parcels and report transit damage promptly.
We will use the contact details you provide to tell you when a device is ready and send reasonable reminders. We do not charge a storage fee. If a device remains uncollected for at least 90 days, we may begin the formal statutory notice procedure for uncollected goods. We will not sell or dispose of a device without first giving the notices and time required by law. Any sale proceeds will be handled as required by law after permitted charges and costs.
9. Product sales
Esky Phone Sales Ltd sells new and Pre-Loved devices and new accessories, including charging plugs and cables. Pre-Loved items have previously been used and prepared for resale. They will be clearly identified and may show reasonable signs of previous use described before purchase.
Each purchased device includes the relevant charging cable, carries the six-month product warranty described below, and will be supplied unlocked unless the product listing or order confirmation clearly states otherwise.
Sales may be made at our workshop, over the phone or through our website. Product descriptions and photographs are intended to be accurate, but minor variations may occur. An online order is an offer to buy. We accept it when we send an acceptance or dispatch confirmation, unless we have already expressly accepted it by another method.
Prices are in pounds sterling and include VAT where applicable. Any postage charge will be shown or agreed before the order is completed. If we cannot supply an item, we will notify you and refund any payment made for it.
10. Returns, cancellations and refunds
Workshop purchases
For a change of mind on an in-store purchase, we offer a seven-day goodwill return for an unused, unopened item in its original packaging with proof of purchase. This goodwill policy is in addition to your legal rights and does not apply where goods are faulty, misdescribed or otherwise fail to conform to the contract.
Online and telephone purchases
Consumers purchasing at a distance normally have 14 days after receiving goods to tell us they wish to cancel, without giving a reason, and a further 14 days to return them. You may inspect goods as you would in a shop. We may make a lawful deduction if handling beyond what is necessary to inspect the goods reduces their value.
Unless goods are faulty or we agree otherwise, you are responsible for direct return costs where this was disclosed before purchase. We will refund the basic outbound delivery charge where required, but not any extra paid for enhanced delivery. Refunds will be made within the period required by law using the original payment method unless agreed otherwise.
Faulty goods
Goods must be as described, of satisfactory quality and fit for purpose. Your statutory remedies may include rejection and refund, repair or replacement, or a price reduction depending on the circumstances and timing. Our goodwill return and warranty policies do not restrict these rights.
11. Our warranties
Repairs completed by Esky Repair Ltd carry a 90-day workmanship warranty from completion. Products sold by Esky Phone Sales Ltd carry a six-month warranty from delivery or collection. These are commercial warranties provided in addition to statutory rights.
A warranty does not cover accidental or liquid damage after supply, misuse, unauthorised modification or repair, normal wear, consumable deterioration, or a separate fault unrelated to the original repair. A customer-supplied part is excluded, although our workmanship remains covered. We may inspect the item before deciding the appropriate warranty remedy.
12. Liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights. Subject to that, we are not responsible for losses that were not reasonably foreseeable, losses caused by information you failed to provide, or business losses suffered by a consumer.
13. Complaints
Please contact us first so we can try to resolve the matter. Include your name, job or order reference and a clear description of the issue. Northern Ireland consumers may also seek guidance from Consumerline.
14. Changes and governing law
We may update these terms for future transactions. The terms applying when you placed an order or approved work will continue to govern that transaction. These terms are governed by the law of Northern Ireland. Courts with legal jurisdiction over the dispute may hear proceedings; consumers retain any mandatory right to bring a claim elsewhere in the United Kingdom.
